Fresh Produce Live Auction — Terms & Conditions

By downloading or using the Fresh Produce Live Auction application (“the App”) developed by 100 Factories (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the App.
1. Description of Service
The Fresh Produce Live Auction App provides real-time agricultural auction price data and trading volume information sourced from public auction markets. The App is designed as an informational tool and does not facilitate actual buying, selling, or bidding of agricultural products.
2. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:
- Use the App for any commercial trading decisions without independent verification of data accuracy.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Use automated systems or software to extract data from the App.
- Redistribute auction data obtained from the App without our express written permission.
- Use the App in any way that could damage, disable, or impair our services.
3. Accuracy of Data
While we strive to provide accurate and up-to-date auction data, we make no guarantees regarding the accuracy, completeness, or timeliness of the information displayed. Auction prices and trading volumes are sourced from publicly available data and may be subject to delays or errors. You should not rely solely on the App for financial or trading decisions.
4. Intellectual Property
All content, features, and functionality of the App — including but not limited to its design, layout, graphics, and software — are the exclusive property of 100 Factories and are protected by applicable intellectual property laws.
5. In-App Purchases and Subscriptions
The App may offer in-app purchases or subscription services. All purchases are processed through the applicable app store (Apple App Store or Google Play Store) and are subject to the respective store’s terms and refund policies. We do not directly process payments.
6. Third-Party Services
The App may use or integrate with third-party services including but not limited to:
- Google Play Services — Required for core functionality on Android devices.
- Google AdMob — Used for displaying advertisements.
- Pangle — Used for displaying advertisements.
- AppLovin — Used for displaying advertisements.
- Meta (Facebook) SDK — Used for analytics and advertising.
- Firebase — Used for analytics, crash reporting, and backend services.
Each third-party service is governed by its own terms and privacy policy.
7. Disclaimer of Warranties
The App is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the App’s reliability, availability, or fitness for any particular purpose. We specifically disclaim any liability for losses arising from trading decisions made based on information provided by the App.
8. Limitation of Liability
To the maximum extent permitted by applicable law, 100 Factories shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to financial losses resulting from reliance on auction data displayed in the App.
9. Changes to the Service
We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. This includes changes to the data sources, features, and pricing.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the updated Terms and revising the “Last Updated” date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
